These terms and conditions are effective 1 July 2009 and supersede all previous terms and conditions where applicable.

1.0 DEFINITIONS

1.1 S Card means the membership and reward program operated by SOGO (K.L.) Department Store Sdn Bhd (KL SOGO) for the benefit of S Card Members.
1.2 S Card Member (Member) means a Member of S Card and shall include a Principal Member and a Supplementary Member.
1.3 S Card Reward Points (S-Points) are defined as the points awarded to S Card Member in accordance with the terms and conditions governing the S Card which may be stipulated by KL SOGO from time to time.
1.4 S Card Rewards (S-Rewards) are defined as the goods and/or services offered to S Card Members in exchange for a specified amount of S-Points as may be stipulated in the S Card Rewards Catalogue.

2.0 MEMBERSHIP

2.1 Application of S Card Membership is open to all Malaysian and non-Malaysian aged 18 years and above, with a permanent residential/correspondence address in Malaysia.
2.2 Employees, Promoters and Tenants of KL SOGO are not eligible to apply for this card.
2.3 An application or renewal fee of RM24 is imposed for a TWO years membership for Principal card and ONE complimentary Supplementary card.
2.4 A processing fee of RM5 will be imposed for replacement of lost, stolen or damaged card of either Principal or Supplementary card. Replacement charge will only be waived with support of police report of lost Identification Card.
2.5 The membership of Supplementary card will expire along with the Principal card's expiry regardless of the application date for the Supplementary card.
2.6 Principal S Card Member reserves the right to terminate the Supplementary card at anytime at his/her own discretion.
2.7 All membership correspondence and promotional information send via Direct Mail, e-mail, SMS etc pertaining to S Card Rewards, Privileges and promotional activities; will be forwarded to Principal Member only. All redemptions of S-Rewards, Birthday Gifts, Rebate Coupon, Gifts and Sample etc (if any) can only be carried out by Principal Member only unless authorised by Principal Member with letter of autorisation and photocopy of Principal Member's identification card.
2.8 S Card/KL SOGO reserves the right to use and utilize the database information for marketing purposes.

3.0 S-POINTS

3.1 One S-Point will be awarded for minimum purchase of RM1 from KL SOGO excluding purchases from the following outlets: D-Cut, Best Denki, Hand Point, Poh Kong, Tokyo Megane, Solar Time, Pure Pharmacy, all F&B, Entertainment and other tenanted outlet.
3.2 In the event there are other concurrent additional S-Points promotions, the recording of S-Points will be based on the highest point scheme determined solely by KL SOGO.
3.3 S-Points shall only be accumulated upon presenting the S Card to the cashier at the time of purchase with valid payment to the cashier and is recorded by the POS system. Backdated receipts are not valid for accumulation of S-Points. Proof of receipt is not proof that S-Points have been recorded.
3.4 S-Points accumulated by the Principal and Supplementary Members are deemed to be accumulated by and recorded in the Principal Member's account.
3.5 Each S-Point has a validity life of 24 months from the month of the points being collected. S-Points which are not used by a member to redeem for Rewards within 24 months after the end of the month in which the points were recorded will expire and be deducted from the Point Balance in the Principal Member's account.
3.6 S-Points are to be used for the sole purpose of redeeming S-Rewards or purchase of selected S-Rewards with reduced prices (FAST TRACK) as may be determined by S-Card/KL SOGO from time to time.
3.7 The number of S-Points published for a S-Reward claimed will be deducted from S-Points Balance of the Member's account, with the oldest S-Points being deducted first.
3.8 S-Points are strictly not transferable. Neither the Principal nor the Supplementary Member shall have any claim against S-Card/KL SOGO or any party in respect of the unredeemed or expired S-Points.
3.9 S-Points and any rights they confer cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these terms and conditions. S-Points cannot be exchanged for cash and do not have any monetary value.
3.10 S Card/KL SOGO reserves the right to deduct any S-Points from the Member's Point balance/account without notifying the Member in the event of
~ any S-Points suspected to be fraudulently recorded.
~ any S-Points recorded in error, and
~ any S-Points relating to a transaction which is cancelled
and/or returned.

4.0 S-REWARDS REDEMPTION

4.1 The Reward items featured in the S-Rewards catalogue are valid during the redemption period as stated.
4.2 Only the Principal Member is eligible to redeem S-Rewards with a valid membersip/non-expired S Card and his/her identification card for verification.
4.3 All S-Rewards must be redeemed personally at S-Rewards Redemption Counters at KL SOGO or any other redemption method in accordance with clause 4.2.
4.4 Redemption of S-Rewards with insufficient S-Points will not be processed.
4.5 Redemption orders once given by Member and accepted by S Card/KL SOGO may not be revoked, canceled, returned or exchanged.
4.6 Certain S-Rewards carry the warranty of their manufacturers. S Card/KL SOGO makes no product representation or warranties, express or implied, and disclaim any and all liabilities, as to the condition, quality or fitness for use of products and services provided through this Program. Should such a Reward requires service, all inquiries should be directed to the manufacturer according to the warranty information.
4.7 Certain Rewards, which are in the form of Rebate Coupon and S-Reward Certificate, are valid for use only at KL SOGO, or participating merchants as mentioned therein. The Rebate Coupon and Reward Certificate are valid for use until the date specified and subject to terms and conditions therein. If they remain unused after the date specified the Coupon/Certificate will lapse and will not be replaced.
4.8 In cases where the Rebate Coupon/Reward Certificate stated a specified amount and if such Rebate Coupon/Reward Certificate is used for a value less than the value of the item(s) purchased, the Member is required to pay the difference to the participating counters/merchants.
4.9 S Card/KL SOGO shall not be liable for any cancellation and /or dissatisfaction of the Holiday Packages, Room Reservations, delay or cancellation in the transportation facilities (where applicable) nor any losses, persons in relation to the Holiday Packages, Room Reservations and transportation facilities.
4.10 S-Rewards stated in the S-Rewards catalogue are available on 'while stocks last' and 'first-come-first-serve' basis. S-Card/KL SOGO reserves the right to adjust the S-Points required for redemption of Rewards as well as substituting or replacing any Rewards with others of appropriate equivalent value without prior notice.
4.11 S Card/KL SOGO reserves the right to refuse the redemption of any S-Rewards or recall the redeemed item if S Card/KL SOGO has any reason to suspect that the S-Points were fraudulently accumulated by the Member or recorded in error.
4.12 S Card/KL SOGO shall not be held liable for any death or injury or consequential loss or damage of any nature arising from the redemption of the Rewards or from the loss, theft or destruction of the Rewards.

5.0 FAULTY REWARDS

5.1 Member is advised to examine all Rewards upon receipt and damaged Rewards should be returned immediately.
5.2 Alternatively, faulty or damaged Rewards should be delivered to the counter/participating merchant issuing the Rewards within serve (7) days of issuance of the Rewards for replacement. All returned Rewards must be accompanied by official redemption receipts/s or else S Card/KL SOGO reserves the right not to accept or replace the damaged Rewards.
5.3 S Card/KL SOGO is entitled to substitute the faulty or damaged Rewards with such other Reward items which it deems fit and such faulty or damaged Rewards cannot be replaced by Points or cash.
5.4 S Card/KL SOGO also reserves the right not to make any replacement if the damaged Rewards are found to be damaged or rendered faulty due to the fault, omission or negligence of the Member and the Points utilized for redemption of the Rewards are not refundable and cannot be re-credited.

6.0 OTHER PRIVILEGES

6.1 Privileges and exclusive promotions extended by external Program Partners to S Card Member are subject to the terms and conditions as specified by the respective participating establishments from time to time.
6.2 S Card/KL SOGO shall not be liable for the non-performance or unsatisfactory performance of any obligations of the participating establishments under this program.
6.3 S Card/KL SOGO shall not be liable for any cancellation or delay of the holiday packages or cancellation of transportation facilities (where applicable), nor any loss or damage suffered by the Member pertaining to the Privileges extended by any of the participating establishments.

7.0 GENERAL

7.1 The S Card is not transferable and remains the property of KL SOGO to whom it must be returned if found or upon request.
7.2 KL SOGO reserves the right to amend the S Card Program mechanics and the terms and conditions herein from time to time at its sole discretion and without prior notice.
7.3 KL SOGO reserves the right to suspend or terminate the S Card Program at anytime it deems necessary and advance notice shall be given to members in the manner they shall deemed appropriate and without any compensation whatsoever being payable to the S Card Members.
7.4 All props used to enhance the products photography are not included. While every care has been taken in the preparation of this website, any inaccuracy or omission is unintentional and is much regretted.
